1. Consent to Photography and Recording
I authorize Endure Pilates LLC ("Endure"), and its authorized employees, contractors, photographers, videographers, marketing representatives, and agents, to photograph, film, video record, and/or audio record me while I am participating in Endure classes, events, promotions, community activities, studio activities, or other Endure-related activities.
2. Marketing and Promotional Use
I grant Endure permission to use, reproduce, edit, crop, adapt, publish, display, distribute, and otherwise use approved photographs, video recordings, audio recordings, and other recordings containing my image, likeness, voice, or appearance for Endure's legitimate advertising, promotional, educational, social media, public relations, and business purposes.
3. Where Content May Appear
This permission may include use on Endure's website, social media accounts, digital advertisements, email marketing, text-message marketing where applicable, printed advertisements, flyers, posters, studio displays, brochures, event materials, presentations, press or public-relations materials, and other Endure-owned or Endure-authorized marketing channels.
4. Editing and Creative Use
I understand that photographs and recordings may be edited for reasonable marketing purposes, including cropping, resizing, color correction, adding text or graphics, combining footage, shortening video, or adapting content to different media formats. Endure will not knowingly use my likeness in a defamatory, misleading, or unlawful manner.
5. No Compensation
Unless Endure and I separately agree in writing, I understand that I will not receive royalties, fees, payment, discounts, or other compensation for Endure's authorized use of content under this consent. I waive any right to inspect or approve the final marketing materials before publication, subject to any limitations I select below.
6. Ownership of Marketing Materials
To the extent permitted by law, Endure or the applicable photographer/content creator may own the photographs, recordings, edits, advertisements, and other marketing materials created from an Endure photo or video session. This consent gives Endure permission to use my likeness as described in this form and does not transfer ownership of my personal identity or likeness to Endure.
7. Privacy and Sensitive Information
Endure will not intentionally publish private medical information, payment information, home address, or other sensitive personal information solely because I sign this consent. This form does not authorize Endure to publicly disclose confidential information unrelated to the marketing content.
8. Revoking Future Consent
I may request that Endure stop making new uses of my identifiable image, likeness, or voice by providing written notice to Endure. I understand that withdrawal may not require Endure to recall, delete, or destroy materials that were already printed, published, distributed, posted, scheduled, licensed, or incorporated into completed marketing materials before Endure received and reasonably processed my request. Endure will make reasonable efforts to discontinue future use after receiving a clear written request.
